Closing on HOA land requires a few extra steps that a standard rural parcel doesn't have. None of them are obstacles — they're just process.
HOA payoff demand. The title company requests an HOA estoppel certificate or payoff letter. This document from the HOA management company states the current dues balance, any unpaid special assessments, and the per-diem accrual rate. It's the official number used on the closing statement.
Transfer fees and capital contribution fees. Many HOAs charge a transfer fee when a lot changes hands — typically $100-$500. Some also charge a "capital contribution" or "initiation fee" from the new buyer. These are standard and the title company includes them in the closing statement.
HOA right of first refusal. Some HOA documents give the association the right to purchase the lot at the offered price before the sale to an outside buyer completes. The title company sends notice to the HOA and waits for the refusal period to expire (typically 10-30 days). If the HOA doesn't exercise the right, the sale proceeds.
